According to a report by Daily Post on Friday, April 24, 2026, A Federal High Court sitting in Abuja has ruled that the Nigeria Police Force and the Federal Road Safety Corps (FRSC) cannot impose fines or penalties on motorists for violating the Third Party Motor Vehicle Insurance Act without first obtaining a valid court order.
The judgment was delivered on Friday by Justice Hauwa Joseph Yilwa, who made it clear that while both agencies have the authority to enforce compliance with the insurance law, they do not possess the legal power to directly sanction offenders without judicial backing.
The case was initiated by legal practitioner Deji Adeyanju, who approached the court seeking clarity on whether the police and FRSC could lawfully penalize motorists without due process. His suit challenged the practice of imposing on-the-spot fines on drivers who fail to comply with the insurance requirement.
Before delivering the final judgment, the court addressed a preliminary objection raised by the Nigeria Police Force. Counsel to the police, Mr. Andrew Victor, argued that the court lacked jurisdiction to hear the case, claiming that the police had not been properly served with the necessary legal documents. He further maintained that questions of jurisdiction can be raised at any stage before a judgment is delivered.
However, Justice Yilwa rejected this argument in a bench ruling, stating that court records clearly showed that all parties involved had been duly served. She listed several dates on which the police were served with the originating summons, indicating that there was sufficient evidence to prove that the force was aware of the proceedings but failed to respond.
According to the judge, the police’s objection appeared to be an attempt to delay or obstruct the delivery of judgment. She consequently dismissed both the preliminary objection and a separate application by another party seeking to be joined in the case.
Proceeding to the substantive ruling, Justice Yilwa held that although the police and FRSC are responsible for ensuring compliance with the Third Party Motor Vehicle Insurance Act, they must follow due legal procedures in enforcing penalties. She emphasized that any fines or sanctions must be backed by a court order, reinforcing the principle of due process.
The decision is expected to have significant implications for how traffic and insurance-related offences are handled across the country, particularly in ensuring that enforcement agencies operate strictly within the bounds of the law.
