According to Daily Post, a Federal High Court sitting in Abuja has restrained the Independent National Electoral Commission (INEC) from recognising any state congresses conducted by committees set up by the David Mark-led caretaker leadership of the African Democratic Congress (ADC).
The ruling was delivered by Justice Joyce Abdulmalik on Wednesday, following a legal dispute over the authority to organise and supervise party congresses within the ADC structure.
The court held that the constitutional responsibility for conducting state congresses lies with duly elected state executive committees of political parties, and not with interim or caretaker national leadership structures.
It further ruled that the tenure of the existing State Working Committees and State Executive Committees of the ADC remains valid and legally binding until properly conducted congresses are held in line with party regulations and a national convention is convened.
The judgment also clarified that neither the Nigerian Constitution nor the ADC constitution empowers a caretaker or interim National Working Committee to unilaterally appoint committees for the purpose of conducting state congresses across the federation.
The case was instituted by a group of ADC members led by Don Norman Obinna, Johnny Tovie Derek, Obah C. Ehigiator, Olona Yinka, Charles Idowu Omideji, Samuel Pam Gyang, and Obianyo Patrick, who acted on behalf of themselves and other state party executives.
The court’s decision effectively places a legal restriction on the recognition of any congresses conducted under the disputed caretaker leadership structure, pending compliance with due internal party processes.
The ruling is expected to have significant implications for the internal leadership dispute within the ADC, as well as the party’s ongoing organisational structure ahead of future electoral activities.
INEC is expected to comply with the court’s directive while the broader leadership crisis within the party continues to attract political and legal attention nationwide.
